Supreme Court denied Government’s request for direct review on DACA

On February 26, 2018, the U.S. Supreme Court denied the US Department of Justice’s request for direct review of the preliminary injunction ending the DACA program.

The Court stated that “[t]he petition for a writ of certiorari before judgment is denied without prejudice.”

This means that for the time being DACA will remain in place. However, the Supreme Court stated, “it is assumed that the Court of Appeals will proceed expeditiously” to make a decision on the case.
